Diehl, who has Croatian roots, had been watching the soccer match between Croatia and Ireland at a bar in Astoria. He did not attempt to flee the scene and failed a breathalyzer test shortly after the incident.

Diehl was arraigned today before Queens Criminal Court judge Lenora Gerald and released. He faces up to one year in jail and/or a $1,000 fine if convicted and his driver’s license is suspended in New York pending prosecution.
Diehl will next appear in court on July 26 - which coincidentally is the opening day of Giants' training camp. He will reportedly be at TIMEX this week to participate in the team's mandatory minicamp, which begins tomorrow.
